Provenienza dei dati personali
I dati personali trattati dal titolare sono forniti direttamente dalla persona interessata. La messa a disposizione dei dati è da ritenersi obbligatoria, soltanto quando riguarda il trattamento obbligatorio per il titolare, per rispettare i diritti della persona interessata in base al contratto intercorrente e le disposizioni normative, legali e regolamentari. Finalità del trattamento
I dati personali forniti sono necessari a titolo identificativo, per gli adempimenti previsti per legge e allo scopo dell’esecuzione del contratto intercorso tra l’interessato e Nutramentis Srl e/o la collaborazione professionale e continua tra l’interessato e Nutramentis Srl. Il trattamento dei dati agli scopi che esulano dall’esecuzione di un contratto, dagli obblighi di legge, norme o direttive, viene effettuato esclusivamente successivamente al consenso volontario ed esplicito e prestato in forma scritta.
Modalità di trattamento e conservazione
Il trattamento sarà svolto in forma telematica, informatizzata e/o manuale, nel rispetto di quanto previsto dall’art. 32 del GDPR 2016/679 e dall’Allegato B del D.Lgs. 196/2003 (artt. 33-36 del Codice) in materia di misure di sicurezza, ad opera di soggetti appositamente incaricati e in ottemperanza a quanto previsto dagli art. 29 GDPR 2016/ 679. Segnaliamo che, nel rispetto dei principi di liceità, limitazione delle finalità e minimizzazione dei dati, ai sensi dell’art. 5 GDPR 2016/679, i Suoi dati personali saranno conservati per tutto il periodo di durata contrattuale e, salvo diversa comunicazione da parte Sua, anche successivamente al fine dell’instaurazione di potenziali ulteriori rapporti contrattuali o del proseguimento del rapporto commerciale.

Datenquelle und Bereitstellung der Daten
Die vom Verantwortlichen erfassten personenbezogenen Daten werden direkt bei der der betroffenen Person eingehoben. Die Bereitstellung der Daten ist nur dann als verpflichtend anzusehen, wenn die Datenverarbeitung der Erfüllung der Pflichten gegenüber der betroffenen Person auf der Grundlage eines bestehenden Vertrags sowie aus Gesetzen, Rechtsvorschriften und Verordnungen dient. Die Nichtbereitstellung der Daten kann dazu führen, dass Nutramentis GmbH die bestehende Rechtsbeziehung nicht ausführen kann.
Zweck der Verarbeitung
Die von Ihnen bereitgestellten Daten sind zu Zwecken der Identifizierung und für die vom Gesetz vorgesehenen Verpflichtungen sowie für die Ausführung des Vertrags und der professionellen und kontinuierlichen Zusammenarbeit zwischen Ihnen und Nutramentis GmbH bestimmt. Die Verarbeitung zu Zwecken, die außerhalb der Erfüllung eines Vertrags, sowie Verpflichtungen aus Gesetzen, Rechtsnormen und Verordnungen liegen, erfolgen ausschließlich nach freiwilliger und ausdrücklicher, schriftlicher Zustimmung der betroffenen Person.
Form der Verarbeitung und Speicherung
Die Datenverarbeitung erfolgt telematisch, elektronisch und/oder manuell, unter Einhaltung der Sicherheitsbestimmungen des Art. 32 der DSGVO 2016/679 und der Artikel 33-36 des italienischen Privacykodex, vonseiten eigens damit betrauter Subjekte und unter Einhaltung der Bestimmungen des Art. 29 der DSGVO 2016/679.
Wir teilen Ihnen mit, dass ihre persönlichen Daten, unter Berücksichtigung der Prinzipien der Rechtmäßigkeit, der maximalen Einschränkung der Datenverwendung, im Sinne des Art. 5 DSGVO 2016/679 für die gesamte Dauer des Vertragsverhältnisses und, außer im Falle einer gegenseitigen Mitteilung Ihrerseits, darüber hinaus, für eine weitere Zusammenarbeit gespeichert werden.

Wir informieren Sie zudem, dass Ihre Daten ausschließlich zu den vom Gesetz vorgesehenen Zwecken und für die Erfüllung der Zwecke des Vertrags, sowie für die von ihnen zugestimmten Zwecke verwendet werden. In diesem Sinne können sie an Berater, öffentliche Einrichtungen, Auftraggeber, Vertreter, Auftragnehmer und wenn nötig, andere Subjekte mitgeteilt werden.
Weitergabe persönlicher Daten
Mit Ausnahme der vom Gesetz vorgesehenen, der für die Vertragserfüllung notwendigen Zwecke und der Zwecke, denen Sie ausdrücklich zugestimmt haben, werden ihre Daten werden weder an Dritte innerhalb der Europäischen Union noch in Drittländer ansässigen weitergegeben.
Besondere Kategorien von personenbezogenen Daten
Im Sinne der Artikel 26 und 27 des gesetzesvertretenden Dekrets 196/2003 und der Artikel 9 und 10 der DSGVO 2016/679, könnten Sie Nutramentis GmbH Daten mitteilen, welche als besondere Kategorien von personenbezogenen Daten gelten, da sie Auskunft über „rassische und ethnische Herkunft, politische Meinungen, religiöse oder weltanschauliche Überzeugungen oder die Gewerkschaftszugehörigkeit, Gesundheitsdaten oder Daten zum Sexualleben oder der sexuellen Orientierung“ geben könnten. Diese Kategorien von Daten können nur mit Ihrem freien und ausdrücklichen Einverständnis, welches im Schlussteil dieser Erklärung schriftlich gegeben werden kann, verwendet werden.
Verarbeitung von Surfdaten
Diese Datenschutzerklärung gilt auch für die Internetauftritte der Nutramentis GmbH. Auf anderen Servern und Internetseiten von Drittanbietern können andere Datenschutzerklärungen anwendbar sein.
Die Datenschutzvorschriften verpflichten uns zum ordnungsgemäßen und zweckgebundenen Umgang mit Daten der Nutzenden/Nutzer. Für andere als die angegebenen Zwecke werden wir deren die Daten nicht verwenden.
Erhobene Daten, Zwecke der Datenverarbeitung und Rechtsgrundlage
Bei jedem Zugriff von Nutzenden auf eine Seite von Nutramentis GmbH und bei jedem Abruf einer Datei werden Daten über diesen Vorgang in einer Protokolldatei gespeichert. Je nach verwendetem Zugriffsprotokoll beinhaltet der Protokolldatensatz Angaben mit folgenden Inhalten:
- IP-Adresse des anfordernden Rechners
- Name der angeforderten Datei
- Datum und Uhrzeit der Anforderung
- vom anfordernden Rechner gewünschte Zugriffsmethoden/Funktionen
- Zugriffsstatus des Web-Servers
- die URL, aus der die Datei angefordert wurde
- Betriebssystem und Browsertyp bzw. Browsereinstellungen.
Es werden keine Nutzungsprofile erstellt, in denen IP-Adressen und personenbezogene Daten verknüpft werden. Etwas anderes gilt nur, soweit dies gesondert in dieser Datenschutzerklärung dargestellt wird.
Die gespeicherten Daten werden ausschließlich zu Zwecken der technischen Bereitstellung der Inhalte, zur Identifikation und Nachverfolgung unzulässiger Zugriffsversuche/Zugriffe auf den Webserver sowie für statistische Auswertungen wie Besucherzahlen und Seitenpopularität verwendet. Die Auswertung erfolgt nur durch autorisierte Mitarbeitende von Nutramentis GmbH.
